Account upgrade terms
1. Acceptance of these Terms
By purchasing, claiming, or redeeming any account upgrade on Insanity Gaming, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, do not complete the transaction.
2. Eligibility
You must be at least 18 years of age to purchase an account upgrade. If you are under 18, you may only purchase an upgrade with the express consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. By completing your purchase, you represent and warrant that you meet this requirement. We may, at our discretion, refuse or reverse any purchase where eligibility cannot reasonably be confirmed.
3. Nature of the Goods
Account upgrades are digital goods. They grant a non-exclusive, non-transferable license to access additional features, perks, or content on Insanity Gaming for the duration specified at purchase. You are not buying ownership of any software, content, or community asset; only access during the term of the upgrade.
4. No Refunds
Account upgrades are digital goods that are delivered immediately and may be consumed on first use. You may request a refund within seven (7) days of your initial purchase, provided you have not yet used the perks granted by the upgrade. "Use" includes, without limitation, accumulating thirty (30) minutes or more of total playtime (across one or more sessions) on any game server where the upgrade is active, or otherwise exercising any perk made available by the upgrade. Refund eligibility is determined at our sole discretion based on our server logs and records.
Once you have used the upgrade, or after the seven-day window has elapsed, all sales are final. We do not offer partial refunds, credits, or pro-rated returns for unused time, account suspensions, voluntary cancellations, dissatisfaction with features, changes to perks, or any other reason.
Recurring subscription renewals are not eligible for refunds; this policy applies only to the initial purchase of a new upgrade. Refunds may still be issued at our discretion in cases of confirmed service outages or delivery errors on our part.
By completing your purchase you expressly consent to immediate performance of the digital content and acknowledge that, upon use, you lose the right of withdrawal that might otherwise apply under applicable consumer protection law.
5. Recurring Subscriptions
If you select a recurring upgrade, your payment method will be charged automatically at the start of each billing cycle until you cancel. You may cancel at any time from your account upgrades page; cancellation stops future charges but does not refund the current cycle. Pricing for renewals may change with at least 14 days' advance notice.
6. Promotional Pricing and Trials
From time to time we may offer promotional pricing, discounts, coupon codes, gift codes, free trials, or introductory rates. These offers apply only for the stated promotional period or to the stated portion of a purchase (for example, the first billing cycle of a recurring upgrade). After the promotional period ends, recurring upgrades will renew at the standard, non-discounted price unless you cancel before renewal.
Promotional offers are not redeemable for cash, may be limited in quantity or duration, and may be modified or withdrawn at any time. We reserve the right to revoke or reverse promotional pricing in cases of suspected abuse, including but not limited to use of multiple accounts, payment fraud, chargeback abuse, or other circumvention of the terms of the offer.
7. Account Responsibility
Upgrades are tied to the receiving account. You are responsible for keeping your account secure. Lost access due to forgotten credentials, account sharing, account suspension for terms-of-service violations, or third-party compromise does not entitle you to a refund or transfer.
8. Privacy
Information related to your purchases, account upgrades, payment activity, and acceptance of these Terms — including your username, IP address, timestamps, and metadata retained by our payment processor — is collected and processed in accordance with our Privacy Policy. By completing your purchase you acknowledge that you have read and understood the Privacy Policy and consent to the processing described therein.
9. Modifications to Service
We reserve the right to modify, replace, or remove individual features included in any upgrade tier. We will make reasonable efforts to maintain equivalent value, but specific perks are not guaranteed for the life of an upgrade.
10. Service Availability
We do not guarantee uninterrupted, error-free, or continuously available access to any server, feature, perk, or benefit associated with an upgrade. Game servers, the forum, payment processing, and third-party services may be unavailable from time to time due to maintenance, outages, network conditions, hardware or software failures, attacks, or events outside our reasonable control. Temporary unavailability does not entitle you to a refund, credit, or extension of an upgrade period, except as expressly stated elsewhere in these Terms or as required by applicable law.
11. Termination and Refusal of Service
We reserve the right, in our sole discretion and to the extent permitted by law, to refuse service, decline or reverse any purchase, suspend or terminate access to upgraded features, or remove any user from upgrade benefits. Grounds for such action include but are not limited to: violation of the site's rules; attempted fraud against the payment system; initiation of a chargeback in bad faith; use of automated tools or scripts to abuse the upgrade system; abuse of promotional pricing, coupon codes, or gift codes; or behavior that, in our judgment, poses a risk to other users, our services, or our community. Termination for cause does not entitle you to a refund.
12. Disclaimer of Warranties
Upgrades are provided "as is" without warranty of any kind, express or implied. To the maximum extent permitted by law, we disclaim liability for indirect, incidental, or consequential damages arising from your use of, or inability to use, any upgraded features.
13. Limitation of Liability
To the maximum extent permitted by applicable law, the total aggregate liability of Insanity Gaming and its operators, staff, contributors, and affiliates arising out of or in any way related to your purchase of, use of, or inability to use any account upgrade — whether in contract, tort, statute, or otherwise — shall not exceed the total amount paid by you for account upgrades during the thirty (30) days immediately preceding the event giving rise to the claim.
In no event will we be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of in-game progress, loss of competitive advantage, loss of opportunity, or loss of data, even if advised of the possibility of such damages.
14. Chargebacks and Disputes
Initiating a chargeback or payment dispute without first contacting us in good faith may result in immediate suspension of your account and forfeiture of any active upgrades. We retain a record of your acceptance of these terms — including the date, time, IP address, and version of the terms in effect — and will provide it to your card issuer if a dispute is filed.
15. Governing Law
These Terms and Conditions, and any dispute arising out of or in connection with them or your purchase of an account upgrade, shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. You agree that any legal action or proceeding arising under or related to these Terms shall be brought exclusively in the state or federal courts located in Delaware, and you irrevocably consent to the personal jurisdiction and venue of such courts.
Nothing in this section limits any mandatory consumer protection rights that apply to you under the laws of your country or jurisdiction of residence.
